Terms of Service

These terms govern your use of DunbarrioSolo. They are written to match how the app works today: a private social journaling practice tool with AI-assisted features, tiered subscriptions, data export, and permanent account deletion.

1. Acceptance of Terms

By creating an account, signing in, or using DunbarrioSolo ("the App"), you agree to these Terms of Service and to the Privacy Policy published alongside them. If you do not agree, do not use the app.

2. Not Medical or Therapeutic Advice

While the App incorporates concepts from psychological research — including expressive writing (Pennebaker, 1986), emotional granularity (Kashdan et al., 2015), Plutchik's model of emotions, and Dunbar's social layer theory — it is not a replacement for professional therapy, psychological counseling, or medical advice.

The AI-generated responses provided by the mascots and the Weekly Weave synthesis are automated reflections designed to facilitate journaling. They are not clinical diagnoses, nor are they generated by mental health professionals. The App may reference research findings in context (for example, when acknowledging sustained writing duration), but this does not constitute clinical guidance.

If you are experiencing a mental health crisis, severe distress, or thoughts of self-harm, please discontinue use of the App and immediately contact professional emergency services or a qualified mental health provider. In the US, you can reach the 988 Suicide and Crisis Lifeline (call or text 988) or the Crisis Text Line (text HOME to 741741).

3. Eligibility and Your Account

You must be at least 16 years old to use the App. By creating an account, you represent that you meet this age requirement. If we learn that a user is under 16, we will delete their account and all associated data.

You are responsible for maintaining the confidentiality of your account credentials. You may authenticate via Google OAuth or email. You may not share your account with others or create multiple accounts.

4. What the Service Does

DunbarrioSolo is a private journaling and relationship-reflection app. It allows you to write private embraces directed at illustrated mascot characters, organize circles of relationships, review a ledger of connection acts, and generate AI-assisted reflections such as mascot replies and Weekly Weaves.

We may change, improve, suspend, or retire features over time. If we discontinue the App entirely, we will provide at least 30 days' notice and ensure users can export their data before shutdown.

5. Your Content

You retain full ownership of the text and data you submit to the App. You give us the limited permission necessary to host, process, secure, and display that content to you inside the service. That permission includes storing encrypted journal content, using it to generate AI features you request, and creating derived product artifacts such as Weekly Weaves and activity summaries. This permission terminates when you delete your content or your account.

DunbarrioSolo is a private-by-default environment. There is no social graph, no public feed, no follower system, and no broadcast mechanism. We do not use your content to train AI models. We do not sell, share, or monetize your content in any way.

6. AI-Assisted Features and Limitations

Some features send your text to third-party AI providers (Anthropic Claude for paid tiers, Google Gemini for free tier) to generate responses or summaries. The App's AI is designed to provide a relational "holding environment" for emotional practice. You acknowledge that:

• AI models can occasionally hallucinate, misunderstand context, or provide incongruous responses. AI output may be inaccurate, incomplete, or emotionally off.
• The AI is strictly constrained to brief, character-driven responses and is not designed to offer life advice, resolve deep psychological conflicts, or act as a sycophantic entity.
• AI output is not medical, legal, financial, or mental health advice. You remain responsible for how you interpret and use it.
• The AI will attempt to direct you to crisis resources if it detects expressions of self-harm or severe distress, but this detection is imperfect and should not be relied upon as a safety mechanism.

You have the option to toggle off "Let the Mascot Answer" at any time if you prefer an unmediated journaling experience.

7. Subscriptions and Billing

The App offers three tiers:

Payments are processed by Stripe. By subscribing, you authorize recurring billing in line with the plan you selected until it is canceled. All prices are in USD.

• Upgrades take effect immediately. The prorated difference is charged at the time of upgrade.
• Downgrades take effect immediately via the Stripe billing portal. You retain access to your current tier's features until the end of the current billing period for already-paid time.
• Cancellations take effect at the end of the current billing period. You retain access until that date. No refunds are issued for partial billing periods, except as required by applicable law.
• Changes. We may modify subscription tiers, circle limits, AI model allocations, and pricing with at least 30 days' advance notice to active subscribers.

If you delete your account, the App will attempt to cancel any active subscription immediately. Account deletion does not automatically create a prorated refund.

8. Acceptable Use

You may not:

• Use the App for any illegal purposes or to harass, threaten, or harm any person
• Attempt to access accounts or data that are not yours
• Circumvent rate limits, subscription restrictions, or security controls
• Submit content designed to manipulate, exploit, or extract the underlying AI models ("prompt injection")
• Use automated tools to scrape, overload, or disrupt the service
• Reverse engineer, decompile, or attempt to extract server-side source code
• Create accounts for the purpose of abusing free-tier resources
• Impersonate another person or misrepresent your identity

We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice depending on severity.

9. Intellectual Property

The App's design, mascot illustrations, character voice profiles, animation assets, branding, and software are the intellectual property of Dunbarrios.com. The 20 default mascot characters (Aloi, Bungo, Charlie, Delel, Esal, Kiko, Lulu, Mona, Nuku, Olil, Puko, Quali, Rina, Solu, Tinsa, Ugini, Vanu, Xoxi, Yana, Ziku) and their associated visual and voice identities are protected creative works.

You may not reproduce, distribute, or create derivative works from the App's mascot assets, animations, or character designs without written permission.

10. Export and Deletion

You can export your data at any time via the Ledger Export feature (.txt, .md, .csv formats). You can permanently delete your account and all associated data at any time via Profile → Settings → Delete My Account.

Deletion is immediate and irreversible — we hard-delete your account credentials, journal entries, ledger history, circle architecture, Weekly Weave archive, and progression data from our active databases. If you want a copy of your data, export it before deleting. See our Privacy Policy for full details.

11. Service Availability

We aim to keep the App available and reliable but do not guarantee uninterrupted operation. The App depends on third-party services (Supabase, Stripe, Anthropic, Google) that may experience outages beyond our control. Maintenance, upstream provider issues, or infrastructure failures may affect the service.

12. Disclaimers

The service is provided on an "as is" and "as available" basis to the fullest extent permitted by law. We do not guarantee that the service will always be available, error-free, or suitable for every purpose. Your use of the App is at your sole risk.

13. Limitation of Liability

To the maximum extent permitted by applicable law, DunbarrioSolo and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the App or its AI features. This includes but is not limited to: emotional distress, relationship outcomes, reliance on AI-generated content, data loss beyond what our backup systems can recover, or third-party service failures.

Our total liability for any claim related to the App is limited to the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater.

14. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the App, your violation of these Terms, or your violation of any third party's rights.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the App will be resolved through binding arbitration under the rules of the American Arbitration Association, conducted in Seattle, Washington. You waive any right to participate in a class action. Either party may seek injunctive relief in a court of competent jurisdiction for matters involving intellectual property or data security.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the version number and date at the top. If changes are material, we will notify you via email or in-app notification at least 14 days before they take effect and may ask you to review and accept the updated terms. Continued use after the effective date constitutes acceptance.

17. Governing Law and Severability

These Terms are governed by the laws of the State of Washington, United States, without regard to conflict of law principles. If any provision is found unenforceable, the remaining provisions continue in full effect.
